CDL Revocation, Suspension or Disqualification

Texas driver licenses, including Commercial Driver Licenses, (“CDL”) are issued through the authority of The Texas Department of Public Safety (“TxDPS”). Along with the power to issue driver licenses is the power to revoke, suspend or disqualify them. There are numerous reasons why TxDPS may legally revoke, suspend or disqualify anyone’s driver license. But with a CDL holder, the number of reasons more than doubles. The problem for CDL holders is compounded by the fact that if their driver license is revoked, suspended or disqualified, they can’t drive for pay. So, qualified legal representation is essential for any CDL holder facing a revocation, suspension or disqualification.

What is the difference between a revocation, a suspension and a disqualification?

Before starting a discussion of how TxDPS can remove driving privileges, it’s important to understand the various actions that TxDPS can take against CDL drivers. Holders of Commercial Driver Licenses can be subjected to revocations, suspensions and/or disqualifications. The difference is that CDL’s can be disqualified for violations of “CDL disqualification statutes,” and can also be revoked and suspended for violations that would cause a revocation or suspension of a non-CDL holder.

CDL Revocation, Suspension or Disqualification

A revocation of a driver license means that driving privileges are withdrawn by TxDPS, subject to possible reinstatement if the driver license holder “cures” the problem that caused the revocation, such as obtaining a current medical certificate. Both CDL’s and non-CDL’s can be revoked.

A “suspension” of a driver license means that driving privileges are removed for a specific time period, such as 60 days. After the expiration of the time period, the driver license is immediately eligible for reinstatement. Additionally, with a suspension, the judge can “probate” the suspension, which allows the driver license holder to retain their driving privileges during the suspension period. Both CDL’s and non-CDL’s can be suspended.

A CDL “disqualification” means that, like suspensions, driving privileges are removed for a specific time period and the driver license is immediately eligible for reinstatement upon expiration of the disqualification period. The difference with a suspension is that the judge can NOT “probate” the disqualification.

The CDL Revocation, Suspension and Disqualification Process and Possible Punishments

By law, before the TxDPS can revoke, suspend or disqualify your CDL, they must mail you a letter, to the address that you have on file with TxDPS, notifying you that they are attempting to withdraw your driving privileges. You may, and should, immediately request a hearing of the matter. But you only have 20 days from the date of that letter to request a hearing. Failure to timely request a hearing will result in a revocation, suspension or disqualification of your CDL. Importantly, timely requesting a hearing “stays,” or stops the removal of your driving privileges until the matter is heard by the court. So, if you receive a letter from TxDPS informing you that they are attempting to revoce, suspend or disqualify your CDL, and you timely request a hearing, your CDL remains valid and legal, and you can continue to legally drive for pay.

If you timely request a hearing, your case will be assigned to one of the Justice of the Peace Courts in the county of your residence. The Court and/or TxDPS will send you a notice of the date, time and location of the hearing. Failing to appear for the hearing will result in a loss of your driving privileges. Your case will be heard by the judge of the court. TxDPS will be represented in court by one of its’ designated representatives, who will present the Departments case against you to the judge. Their case will include the petition that they filed, along with any evidence, including your driving record and any records of the specific charges against you. After the TxDPS representative finishes presenting their case, you will be given an opportunity to present evidence and make arguments.

At the conclusion of the presentation of evidence and arguments, the judge will make a decision in the form of an “Affirmative” finding or a “Negative” finding. If the finding is “Negative,” you won! With an “Affirmative” finding, you lost and you may lose your driving privileges. If it is a “suspension” that is sought, the judge may “probate” the suspension, which allows you to continue to drive for pay during the probation period. With a revocation and/or a disqualification, the judge can NOT probate the loss of your driving privileges. There’s no time limit on a revocation, since it can possibly be cured by the driver license holder. The length of a suspension or disqualificaton depends on the underlying violations. The Texas Transportation Code provides judges with broad discretion regarding suspension periods, including time periods up to 2 years. For CDL disqualifications the time periods for loss of driving privileges includes, - 60 days, 120 days, one year, three years, or lifetime. Loss of driving privileges, in the event of an Affirmative Finding, begin on the 11th day after the hearing, unless probated in the case of suspension.

Just because you get a TxDPS letter notifying you of a revocation, suspension or disqualification, doesn’t mean they will win or that you can’t continue to drive - You can fight and win!

Your CDL license can be revoked, suspended or disqualified for a multitude of reasons. The TxDPS letter you receive, notifying you of the Departments action against you, will normally inform you of what they claim you did to justify the loss of driving privileges. But, even if you did exactly what TXDPS says you did, you can still fight them in court … and you can win! After receiving a TxDPS suspension letter, don’t sit back and do nothing. That will guarantee a loss of your driving privileges. Take positive action. Your first order of business should be to call us to successfully defend you against these charges. Occupational Driver License Is Not Much Help for CDL Drivers

During times of revocations, suspensions or disqualificaitons, CDL holders can apply for an Occupational Driver License, which is a temporary and restricted driver license. This type of driver license is available to CDL and non-CDL drivers. But, the name is a bit misleading. Although CDL holders can obtain an Occupational Driver License, it does not allow them to drive for pay, but rather, only for non-commercial purposes. So, it’s not a replacement for a CDL, but it does allow you to legally drive for personal or household reasons.
